Subletting

If you are going to work or study in another location, but do not want to give up your accommodation, you may have the option to sublet the apartment.
Please note that subletting always requires Hyresbostäder’s approval. Subletting without our approval may be grounds for termination.

A sublet is only permitted for a limited period.

You, as the primary tenant, are always responsible for the property being managed both financially and in the event of any damage or disturbances in the accommodation.
If you have valid reasons for subletting, please contact the office to obtain our application form.

All sublets are subject to permission. Even shorter, unauthorized sublets can lead to the termination of the lease. It may also be considered a hotel-like operation, which is contrary to the purpose of the lease. And if, in addition, it takes place at too high a rent, the tenant risks being convicted of a crime.

Subletting requires the landlord’s consent

You may not sublet your apartment without the landlord’s consent or the Rent Tribunal’s permission. If you sublet your apartment without permission, you risk losing your lease immediately. Previously, as a tenant, you had the opportunity to take corrective action, that is, to stop the subletting, or to apply for the Rent Tribunal’s permission and have the application granted. That possibility no longer exists.

Sublet rent amount

You may not charge a higher rent than what you yourself pay. The primary rent is therefore a ceiling for the sublet rent. If you rent out your apartment fully furnished, you may make an addition of no more than 15 percent. If electricity, broadband, TV channels or similar are included in the rent, you may only charge for your own costs. You risk losing your lease with immediate effect if you charge too high a rent.

Lodger

Having a lodger does not require the landlord’s consent. However, you must use the apartment as your permanent residence, or have it as a so-called supplementary residence, for it to be a lodger situation. The rent that the lodger pays to you must be proportional to the rent you yourself pay. A lodger who has half of the apartment at their disposal should therefore not pay more than half of the primary rent.

Apartment exchange

Consent from the landlord or permission from the Rent Tribunal is always required for you to be able to carry out an apartment exchange. Both the tenant who wants to transfer their apartment and the one to whom the apartment is transferred must have been living in their apartments for at least one year.

Illegal in some cases

Since October 1, 2019, it has been a crime to sublet your apartment without the landlord’s consent, or the Rent Tribunal’s permission, and to receive a rent that is not reasonable, that is, too high. It is also a crime to mediate, sell and buy leases. Previously, it was only a crime to request payment for leases. The penalty for mediating, selling or buying leases is fines or imprisonment.

Registered at the correct address

You must be registered where you live. Since July 1, 2018, it has been a crime to provide incorrect information or to not report changed registration information to the Swedish Tax Agency when moving. The penalty is fines or imprisonment.
